How do I get a protection from violence order?
The initiation of obtaining a protection against violence order begins
with the filing of a petition with the court. Once the petition is filed,
it is presented to a judge and a temporary 15-day order is granted. This
gives time for the parties to appear at a court hearing, which is scheduled
within that 15-day period. If the petition is initially denied by the
judge, it is often as it appears that there is no "immediate or present
danger of violence" as seen by the court after reviewing the petition.
The assistance of a Jacksonville family lawyer is invaluable when filing
a petition, as they have the skill required to plead all of the facts
sufficient to obtain a temporary order. If the petition is accepted and
a hearing is set, evidence will be taken into consideration in order to
arrive at a final decision. A final order will usually order the offending
party to stay away from the victim, attend parenting classes, substance
abuse counseling, or other relevant counseling, and prohibit the offender
from possessing firearms during the life of the order.
